Beoflow is a biotracking and aerobic load management system that utilizes integrations from pre-existing biotracker platforms to provide users with a comprehensive view of their health and fitness data.
The Beoflow service is accessible via the web application located at app.beoflow.com (referred to throughout these Terms as "the Site") and via the Beoflow mobile application (collectively with the Site, "the Platform").
Beoflow incorporates artificial intelligence features ("AI-Powered Features") as a core component of the Service. The nature of these features, and your rights and obligations in connection with them, are described in the AI-Powered Features, AI Disclaimers and Limitations, User Responsibility, and External Content sections of these Terms.
By installing the Beoflow software/application or otherwise using the Service, you agree to be bound by the terms of these Terms and Conditions as well as the Beoflow Privacy Policy ("Privacy Policy") including without limitations, the disclaimers, limitation of liability and data use.
By agreeing to our Terms and Conditions you agree to the following. Please be aware that failure to comply with the Terms and Conditions of the platform may result in charges made against you or removal from the Service.
You agree to promptly report any violations of these Terms and Conditions by other users or third parties to Beoflow.
Upon your acceptance of this agreement and payment of the associated fees, Beoflow grants you a non-exclusive, non-transferable and non-sublicensable, limited right and license to use the Service strictly for your own benefit.
You may not reverse engineer, decompile, disassemble or otherwise attempt to discover the source code, underlying ideas, underlying user interface techniques, algorithms, or underlying AI models and algorithms of the software by any means whatsoever, directly or indirectly, or disclose any of the foregoing.
You may not loan, rent, lease, sublicense, distribute or otherwise transfer all or any portion of the Service to third parties. You may not modify, adapt or translate the software/application. You may not, directly or indirectly, encumber or suffer to exist any lien or security interest on the software/application or knowingly take any action that would cause the software/application to be placed in the public domain. You will comply with applicable law and Beoflow's instructions regarding the use of the Service.
You acknowledge the Service and the Beoflow software/application is the intellectual property of and is owned by Beoflow. You acknowledge that Beoflow retains all right, title and interest in and to all patents, copyrights, trade secrets, trademarks and other intellectual property rights pertaining to the software/application. You will take no actions adversely affecting Beoflow's intellectual property rights in the software/application. Except as expressly stated above, this agreement does not grant you any intellectual property rights in the software/application and you hereby agree to waive any such rights that may be afforded to you by applicable law. Notifications of claimed copyright infringement should be sent to Beoflow as further provided on the Platform.
In order to use the Service, an account creation step is required in which you will register yourself as a user. As part of the registration process, you will provide the Service with personal data. By registering and providing personal data, you confirm that all information that you have provided is accurate and you retain the responsibility to keep your personal data current for as long as you make use of the Service. You accept that registration is mandatory for use of the Service and you acknowledge that it is your responsibility to protect your login credentials to prevent unauthorized access to your account.
The Service allows you to view your CHI and to receive updates containing your CHI via third-party services. You understand that the Service uses third-party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service. You understand that the quality and accuracy of the Service provided is only as reliable and consistent as the data recorded. Beoflow uses analytics software to monitor usage patterns within the Platform for the purpose of maintaining and improving the Service. Support for the Service is only available in English, via email or WhatsApp messaging. We provide no guarantees for the level of support unless stipulated by an additional contract or service level agreement.
The Service incorporates AI-Powered Features that process your health and fitness data as a core part of the Service. Please refer to Sections 15, 16, 17, and 18 for a full description of AI-Powered Features and your rights and obligations in connection with them.
The Service relies on integrations with third-party devices, platforms, and services to receive your CHI and other data. When you connect a third-party integration to your account, you authorise Beoflow to receive and process the data made available through that integration. Beoflow is not responsible for the accuracy, completeness, or timeliness of data received from third-party sources, nor for any interruptions, changes, or discontinuations to third-party APIs or services. Your use of any third-party device or platform remains subject to that provider's own terms and policies.
When a user grants the Service permission to transmit your CHI, PI or other data to a third-party, it signifies the user's agreement and understanding that following this transmission, Beoflow will no longer be responsible for the aforementioned data. Furthermore, it is important to note that Beoflow is not accountable for the data security of third-party channels or services receiving your transmitted data. In addition to this, our Service may feature links to third-party websites or services that are not under the ownership or control of the Company. In such cases, the Company lacks control over these entities and assumes no responsibility for their content, privacy policies, or practices. You also recognize and accept that the Company bears no responsibility or liability, whether direct or indirect, for any damage or loss resulting from or allegedly connected to your use of or reliance on content, goods, or services offered on or through these third-party websites or services. For your own protection, we strongly recommend that you carefully review the terms and privacy policies of any third-party websites or services you choose to visit or use as a part of the Service.
Beoflow and its affiliates do not and cannot warrant the performance or results you may obtain by using the Service, that the Service will meet your requirements or operate in the combinations which may be selected for use by you, that the operation of the Service will be uninterrupted or error free, or that all errors will be corrected. A warranty for loss of data is not implied. Beoflow and its affiliates make no warranties, conditions, representations or terms, express or implied, whether by statute, common law, custom, usage or otherwise as to any other matters. To the maximum extent permitted by applicable law, Beoflow disclaims all other warranties and conditions, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, satisfactory quality, informational content or accuracy, quiet enjoyment, title and non-infringement, with regard to the Services, and the provision of or failure to provide support service.
Beoflow does not provide medical advice or diagnosis. Any information and guidance provided by the Service are for informational purposes only and not a substitute for professional medical advice. Specific limitations relating to AI-Powered Features are set out in Section 16. If you seek medical advice please contact your medical professional.
To the maximum extent permitted by applicable law even if a remedy fails its essential purpose, in no event shall Beoflow be liable for: (a) any special, incidental, direct, indirect, punitive or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the Services or the provision of or failure to provide support services, even if Beoflow has been advised of the possibility of such damages or (b) any claim or demand made by a third party against you except for claims of personal injury or damages to tangible property. In any case, Beoflow's entire liability under any provision of this agreement shall be limited to the amount actually paid by you for the use of the services in the 12 months preceding the event causing the damages.
By using and/or accessing any part of our sites or services, you unconditionally and expressly acknowledge, represent and agree that you:
Provide accurate personal information, and health and fitness metrics (CHI), when setting up your profile and using the app.
Take responsibility for configuring your privacy settings and sharing your data with other users or the public as desired.
Safeguard your login credentials and take necessary precautions to prevent unauthorized access to your account and personal information. This includes selecting a strong password and refraining from sharing your login credentials with others.
Interact with other users respectfully and refrain from any offensive, harmful, or discriminatory behavior in comments, messages, or other interactions within the app.
Regularly review and update your health and fitness data to maintain its accuracy, reflecting your current status.
If you decide to share your health and fitness data with healthcare providers or other authorized individuals, ensure it is done securely and in compliance with applicable regulations.
Report any app-related issues promptly and provide constructive and respectful feedback to Beoflow support.
Keep your Beoflow app updated to access new features, security improvements, and performance enhancements.
Familiarize yourself with and adhere to Beoflow's community guidelines, which include respectful interactions, no spamming, and no sharing of inappropriate content.
Seek appropriate consent from individuals if you intend to share their health or fitness data within or outside of the app, respecting their privacy and rights.
Prioritize your safety and the safety of others when participating in fitness challenges or competitions organized through Beoflow, and follow safe practices and recommendations.
Stay informed about new app features, updates, and changes by regularly reviewing notifications, emails, or in-app announcements.
User data provided to us will be processed in accordance with our Privacy Policy. Beoflow does not sell, rent, or trade your personal data or health data to third parties. We highly recommend that all users review our Privacy Policy from time to time to understand how their data is collected, processed, and protected. Our commitment to data privacy and security is of utmost importance, and we strive to maintain transparency in our data processing practices. Beoflow may modify these Terms and Conditions and the Privacy Policy at any time by posting the revised Terms of Service or the Privacy Policy on the Platform. Your continued use of Beoflow after any such modification constitutes your acceptance of the revised Terms and Conditions or/and the Privacy Policy.
The user acknowledges the following terms of payment:
All payments made to Beoflow are considered final and non-refundable unless otherwise explicitly agreed upon by Beoflow or mandated by a court of law. Recurring subscriptions will be collected on a monthly basis by our trusted online payment provider, Stripe, using the payment method provided by the user at the time of subscription. In the event that a user fails to complete a payment by the due date, Beoflow reserves the right to suspend all account services until the outstanding payment has been received. During this suspension, access to the platform and associated services may be restricted until the payment is successfully processed. Any disputes related to payments or billing issues should be promptly communicated to our customer support team. We encourage users to resolve such matters amicably through our support channels before pursuing any other actions. Beoflow retains the right to update its pricing and payment terms, and any changes will be communicated to users in advance, allowing them to make informed decisions regarding their subscriptions and payments. By using Beoflow's services, you signify your understanding and acceptance of these payment terms.
You acknowledge and agree that Beoflow may, in its sole discretion, suspend or terminate your account and/or deny you access to or use of all or part of the Platform, without prior notice, for any reason, including, without limitation, if you engage in any conduct that Beoflow believes, in its sole discretion: (a) violates any term or provision of this Terms of Service and use; (b) violates the rights of Beoflow or our partners; (c) is otherwise inappropriate for continued access and use of the Platform; or (d) if you fail to meet the payment obligations as described in the Terms of Payment section. In addition, Beoflow reserves the right to terminate inactive membership accounts. Upon termination or suspension, regardless of the reasons therefore, your right to use the services available on the Platform immediately ceases, and you acknowledge and agree that we may immediately deactivate your account. We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by us in connection therewith.
If you choose to terminate your subscription, you may request account deletion directly through the app. Following your confirmed deletion request, your account will enter a 30-day grace period before permanent deletion. You may reactivate your account at any time during this period by logging in, entering your password, and confirming reactivation. If no reactivation is made within 30 days, your account and associated data will be permanently deleted in accordance with our Privacy Policy. Please refer to Section 12 of our Privacy Policy for full details of the account deletion process.
AI-Powered Features use automated and probabilistic models to deliver personalised health and fitness outputs. AI-Powered Features are intended for general informational, wellness, and educational purposes only.
AI-Powered Features process your health and fitness data as an integral part of the Service. This includes the processing of your data in connection with your use of features within the app.
AI-Powered Features may process your synced data to detect patterns and generate recommendations. Where AI-Powered Features recommend changes to your training programme or outputs, such recommendations are presented to you for review and require your explicit confirmation before being applied.
You may choose not to engage with certain interactive AI features, such as the AI chat interface, but you acknowledge that AI-Powered Features may process your data in connection with your use of the Service. During onboarding, you will be asked to provide separate, specific consent to the processing of your health and fitness data by AI-Powered Features. This consent is in addition to your acceptance of these Terms and the Privacy Policy. By creating an account and using the Service, you acknowledge and accept that this processing is integral to the product you are receiving.
AI-Powered Features are powered by one or more open-source large language models operated by Beoflow through a third-party AI infrastructure provider. Beoflow may update or replace the underlying AI models from time to time without prior notice.
User data may also be processed by AI-Powered Features as part of the Service. Details of how data is collected, processed, and protected in connection with AI-Powered Features are set out in the Privacy Policy.
Beoflow may modify, update, restrict, suspend, or discontinue AI-Powered Features at any time without notice. AI models, system behaviour, and outputs may change over time due to system updates, model retraining, data availability, or technical adjustments. Past outputs do not guarantee future results.
Beoflow is committed to compliance with applicable regulations governing artificial intelligence systems, including Regulation (EU) 2024/1689 of the European Parliament and of the Council on Artificial Intelligence ("EU AI Act") where applicable to the Service. Where required by applicable law, Beoflow will provide transparency regarding the use of AI systems within the Service and make available such information as is required under applicable legislation. This section will be updated as regulatory obligations evolve.
With respect to AI-Powered Features, you may not: (i) probe, test, or attempt to circumvent security or system safeguards protecting the AI infrastructure; or (ii) use AI-Powered Features in a manner that interferes with the integrity, performance, or availability of the Service.
Beoflow and its AI-Powered Features are not medical devices and do not provide medical advice, diagnosis, treatment, or clinical services. The Service is not intended to prevent, diagnose, treat, cure, or manage any disease, injury, or medical condition. No doctor-patient, therapist-patient, coach-athlete, or other professional relationship is created through use of the Service.
AI-generated outputs are based on limited data inputs and automated processing. Such outputs may not account for your full medical history, underlying conditions, medications, injuries, or other relevant circumstances.
You should consult a qualified healthcare professional or appropriately licensed practitioner before beginning, modifying, or discontinuing any training programme, exercise regimen, recovery protocol, or health-related intervention.
You should never disregard professional medical advice or delay seeking it because of information provided through the Service.
AI-Powered Features operate using automated and probabilistic systems. Outputs may be incomplete, inaccurate, outdated, inappropriate, or unsuitable for your individual circumstances. The tone, specificity, or apparent confidence of an AI-generated response does not indicate its accuracy, safety, or suitability. AI systems may produce outputs that are factually incorrect, misleading, or internally inconsistent, including where the system presents information with apparent confidence. This is an inherent characteristic of current AI systems (commonly referred to as "hallucination") and does not constitute a defect in the Service.
AI systems do not independently verify the accuracy of data synced from third-party devices or manually entered by users. Beoflow is not responsible for inaccuracies, errors, delays, synchronisation failures, or data loss resulting from faulty hardware, sensor errors, incorrect device usage, or changes to third-party APIs. Outputs are dependent on the accuracy, completeness, and timeliness of the data available at the time of processing.
You are solely responsible for reviewing, verifying, and evaluating any AI-generated output before relying on it. Beoflow does not guarantee performance improvements, goal attainment, physiological adaptation, injury prevention, or any specific outcome. To the fullest extent permitted by law, Beoflow disclaims any liability for decisions made, actions taken, or results obtained based on AI-generated content.
AI-Powered Features are not intended for use in emergency situations or for urgent medical, health, or safety decisions. If you believe you are experiencing a medical emergency, contact emergency services immediately.
Participation in physical training, exercise, and performance-oriented activities involves inherent risks, including injury, illness, permanent disability, and death.
By using Beoflow and its AI-Powered Features, you acknowledge and agree that:
To the maximum extent permitted by applicable law, you acknowledge and agree that any decision to follow, implement, modify, or rely upon AI-generated workouts, recommendations, or insights is made voluntarily and at your sole risk. Beoflow shall not be liable for any injury, illness, loss, damage, or adverse outcome arising out of or related to your use of, reliance upon, implementation of, or interpretation of AI-Powered Features, including where such outcome results from actions taken in response to AI-generated content.
Beoflow and its AI-Powered Features may reference, summarise, or provide links to third-party websites, research publications, journals, articles, or other external materials ("Third-Party Content") for informational purposes.
Third-Party Content is not controlled, verified, endorsed, or guaranteed by Beoflow. Such content may be inaccurate, incomplete, outdated, or inapplicable to your individual circumstances.
AI-generated citations, summaries, or references may contain errors or misinterpretations and are not independently verified by Beoflow.
You are solely responsible for evaluating any Third-Party Content before relying on it. To the fullest extent permitted by law, Beoflow disclaims any liability for loss, injury, damage, or adverse outcome arising from your access to or reliance upon Third-Party Content. Your use of any third-party website or resource is at your own risk and subject to that third party's terms and policies.
The validity, interpretation, and performance of this agreement shall be controlled by and construed under the laws of the Netherlands as if performed wholly within the Netherlands and without giving effect to the principles of conflicts of laws. The parties hereby consent to the exclusive jurisdiction of the Court of Leeuwarden. In any suit or proceeding between the parties relating to this agreement, the prevailing party will have the right to recover from the other its costs and reasonable fees and expenses of attorneys, and other professionals incurred in connection with the suit or proceeding, including costs, fees and expenses upon appeal, separately from and in addition to any other amount included in such judgment. This provision is intended to be severable from the other provisions of this agreement, and shall survive and not be merged into any such judgment.
These Terms, along with our Privacy Policy, contain the entire agreement between the parties with respect to the sites and services, and supersedes all prior and contemporaneous representations, promises, agreements and understandings, whether oral or written, between the parties. If any provision of these Terms is deemed to be invalid or unenforceable, the remaining provisions of these Terms shall be valid and binding and of like effect as though such provision were not included.
